Who I am

This site is run by Jay Olson, doing business as Jay Olson Photography, a small photography business based in San Luis Obispo County, California. When these terms say "I," "me" or "my," that's me. "You" is you.

By using this site or buying from it, you agree to these terms, my Privacy policy, and my Shipping & returns policy.

Orders and pricing

• Prices are in US dollars. Sales tax is added at checkout where it applies.
• Checkout and payment are handled securely by Shopify.
• Every print is made to order just for you. Your order is confirmed once payment goes through and you get a confirmation email.
• Prices and products can change, but the price you paid is the price you paid.
• Mistakes happen. If a price or description on the site is wrong, I'll let you know before your print is made. You can go ahead at the right price or cancel for a full refund.
• I may cancel an order I can't fill, with a full refund.

About your print

I check every photo and work with professional print labs to make prints I'm proud to put my name on. A few things to know:

• Color. Every screen shows color a little differently, so your print may look slightly different than it does on your phone or computer.
• Sizes. Listed sizes are the print size. Frames and canvas depth add a little to the overall size.
• Canvas edges. I'll check with you by email on how you'd like the edges before your canvas is made.
• Custom sizes. Bigger sizes set up with me by email are made just for you and are final sale.

Shipping and returns

Free US shipping, delivery times, damaged prints, returns for store credit and cancellations are all covered on my Shipping & returns page. That page is part of these terms.

Gift cards and store credit

• Gift cards and store credit never expire and have no fees.
• They can be used on this site and on avila-beach.com, which share the same print shop.
• They can't be returned or exchanged for cash, except where the law requires it. In California, if your gift card balance drops under $10, you can ask for it in cash.
• Treat a gift card like cash. I can't replace one that's lost or used by someone else.

Copyright: who owns the photos

Every photo on this site was taken by me, and I own the copyright to all of them, along with the videos, words and design of the site.

When you buy a print, you own that physical print. You can hang it, gift it or sell it someday. Buying a print doesn't give you the right to copy it, scan it, or make new prints, products or digital files from it.

Please don't download, copy, screenshot to reuse, edit, or post my photos as your own. That includes using them to train AI, making NFTs, or printing them on anything.

Want to use one of my photos?

I'd love to hear from you. I license photos for all kinds of uses, like websites, ads, magazines, books, menus, hotel and office walls, and more.

• Sharing is great. You're welcome to share a link to my site, or reshare my posts on social media using the share button, with my name or tag still on it.
• Everything else needs a license. Any other use, personal or business, needs my written OK first.
• I license, I don't sell copyright. A license gives you the right to use a photo in a specific way. I keep the copyright and don't do buyouts.
• Hired me for a project? The photos and video I create for you come with the usage we agree on in writing, and I keep the copyright unless we agree otherwise.

Using this site

Please use the site the way it's meant to be used. Don't try to hack it, overload it, scrape or copy its photos or content, send spam through the forms, or use it for anything illegal.

The site links to other sites like Shopify, YouTube and social media. I'm not responsible for those sites, and their own terms apply when you use them.

The legal part

As is. I work hard to keep the site accurate and working, but it's provided as is, without warranties beyond what the law requires. Nothing here limits your rights as a consumer under California law.

Limits. To the extent the law allows, my total responsibility for any claim related to an order is limited to what you paid for that order, and I'm not responsible for indirect or unexpected losses.

California law. These terms are governed by the laws of the State of California. Any dispute will be handled in the courts of San Luis Obispo County, California. Before anything formal, please email me. Most things can be sorted out with a quick note.

The rest. If any part of these terms can't be enforced, the rest still applies. If I don't enforce something right away, I haven't given up the right to later.

I may update these terms from time to time. The date below shows the latest version, and the terms in place when you ordered apply to your order.
